PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order of the 3rd respondent dated 09.08.2025 and quash the same as illegal and consequently direct the respondents to issue Patta in the name of the petitioner based on the representation of the petitioner dated 23.07.2025. ORDER

An order dated 09.08.2025 of the Tahsildar rejecting the petitioner's request for patta is challenged in this writ petition primarily on the ground that the said order is unreasoned.

2. Learned counsel for the petitioner submits that the petitioner purchased the property under sale deed dated 10.06.2024 and had applied for patta. Such patta was granted to the petitioner only in respect of S.No.1327/2A2. He submits further that no interim orders were issued in the pending civil suit. He also refers to proceedings of the Revenue Divisional Officer relating to only Item No.2 at paragraph 3 of the affidavit.

3. On perusal of the impugned order, it is noticeable that the application has been rejected by stating that the case is pending before the Court. No further details are set out in the impugned order with regard to the nature of the case, the plaintiff therein or the relief claimed or granted therein. Because the order is unreasoned, the order cannot be sustained and is hereby set aside. As a consequence, the matter is remanded for reconsideration of the Tahsildar. After providing a reasonable opportunity to the petitioner, pattadhar under the relevant pattas and the plaintiff in the relevant suit, a speaking order shall be 2/4

issued within three months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is also closed.
