Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents herein to open and operationalize the newly constructed Gandhi Memorial Daily Market in Puliyangudi Municipality, Kadayanallur Taluk, Tenkasi District and to close the temporary market operating in the private premises by considering the petitioners representation dated 16.10.2025. ORDER
The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records for the records pertaining to the Impugned Order passed by the first respondent vide his proceedings in Pa.Mu.NO.E-3689187/2025/J dated 25.10.2025 and quash the same as illegal and direct the 1st respondent to issue suitable direction to the 2nd and 3rd respondent to restore the name of the petitioner in the revenue records and to remove the entry in the Encumburance Certificate"

2. Mrs.S.Jeya Priya, learned Government Advocate takes notice on behalf of the respondents 1 and 2. Mr.G.V.Vairam Santhosh, learned Additional Government Pleader takes notice on behalf of the 3rd respondent.
3. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.
4. The above writ petition has been filed for the following relief:- The petitioners would submit that the 4th respondent municipality has newly constructed 74 shops in the Gandhi Memorial Daily Market in Puliyangudi Municipality, Kadayanallur Taluk, Tenkasi District. Out of which three shops have been allotted to the petitioners herein. At this juncture, only 10 shop owners are doing their business in the newly constructed shops and the remaining shop owners are continuing to do their business in the private place allotted to them earlier. Due to which, the people are not coming to purchase goods from the new shops. 3/6

In this connection, the petitioners and others have sent a representation to the respondents on 16.10.2025 and based on the said representation, the 1st respondent had sent a communication dated 27.10.2025 to the 4th respondent to take necessary action. However, the same has not been considered to date. Therefore, the petitioner is before this Court.
6. Mrs.D.Farjana Ghoushia, learned Special Government Pleader appearing for the respondents 1 to 3 would submit that the representation submitted by the petitioner dated 16.10.2025 will be considered and orders will be passed within the time stipulated by this Court.
7. In view of the same, without expressing any opinion on the merits of the matter, the respondents 1 to 3 are directed to consider the representation of the petitioner dated 16.10.2025 and pass final orders on its own merits and in accordance with law, within a period of two (2) weeks from today.
