PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 3rd to 5th respondents, consider the petitioner's representation dated 24.04.2024 and pass Award in the Land Acquisition Proceedings initiated in the Notification Na.Ka.No.C.2/17641/2008 dated 11.01.2023 and disburse the Compensation for the acquisition of wet land of 9 ac. 70 1/2 cents in Survey No. 29/1, 29/2, 30/2, 30/3, 30/1, 32/1, 32/3, 32/4, 32/5, 32/7, 33/2 and well with 7.5 HP Motor Pumpset in Survey No. 33/3 situated in Renganathapuram North Village, Krishnarayapuram Taluk, Karur District and compensation for loss tress and loss of recurring income from the said land and trees from the year 2014 along with additional value, solatium and interest etc from the year 2018, as per the Right To Fair and Resettlement Act, 2013, within a time limit to be fixed by this court. ORDER

The petitioner owned 9 ares and 70 1⁄2 cents of wetland in survey numbers mentioned in paragraph 2 of the affidavit. Acquisition proceedings were initiated in the year 2018. The notification was published on 11.01.2023 under Section 11(1) of the Act of 2013. The petitioner relies upon multiple communications with regard to the issuance of an Award and payment of compensation. In spite of lapse of considerable period of time, it is stated that the award has not been issued and compensation has not been paid. 2/5

2. Learned Special Government Pleader accepts notice on behalf of all the respondents. He submits that the matter is pending before the Principal Secretary, Finance Department and that about six months is required to complete the process.

3. The position that emerges on examining the affidavit and documents is that the petitioner is not in a position to use his land in view of the acquisition proceedings. He has also not received any compensation till date. In these circumstances, it is just and necessary that action be taken on an expeditious basis to issue an award and pay compensation.

4. Accordingly, the respondents 3 to 5 are directed to issue the award and disburse the compensation to the petitioner for the acquisition within four months from the date of receipt of a copy of this order.
