PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS directing the 3rd to 5th Respondents, consider 1/5

the petitioners representation dated 24.04.2024 and pass Award in the Land Acquisition Proceedings initiated in the Notification Na Ka. No.C. 2/17641/2008 dated 11.01.2023 and disburse the Compensation for the acquisition of wet lands of 52-3/4 cents (out of 0.85.0 ha.) in Survey No.30/2, 18 cents in Survey No.30/3 and 29/1, 0.07 cents (out of 0.11.5 ha.) in Survey No. 29/2 (totally 77-3/4 cents) along with 1/4 share in the Well and 5 HP Motor Pumpset in Survey No.30/2 situated in Renganathapuram North Village, Krishnarayapuram Taluk, Karur District and compensation for loss trees and loss of recurring income from the said land and trees and other crops from the year 2014 along with additional value, solatium and interest etc from the year 2014, in accordance with the Right To Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, within a time limit to be fixed by this Court.

ORDER

The Association of Rural Education and Development Service owned lands as per details set out in paragraph 2 of the affidavit. Acquisition proceedings were initiated in the year 2018. The notification was published on 11.01.2023 under Section 11(1) of the Act of 2013. The petitioner relies upon multiple communications with regard to the issuance of an Award and payment of compensation. In spite of lapse of considerable period of time, it is stated that the award has not been issued and compensation has not been paid. 2/5

2. Learned Additional Government Pleader accepts notice on behalf of all the respondents. He submits that the matter is pending before the Principal Secretary, Finance Department and that about six months is required to complete the process.

3. The position that emerges on examining the affidavit and documents is that the petitioner is not in a position to use his land in view of the acquisition proceedings. He has also not received any compensation till date. In these circumstances, it is just and necessary that action be taken on an expeditious basis to issue an award and pay compensation.

4. Accordingly, the respondents 3 to 5 are directed to issue the award and disburse the compensation to the petitioner for the acquisition within four months from the date of receipt of a copy of this order.
