PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in Oo.Mu.Aa. 2/7150/2024 dated 21.01.2025 on the file of the first respondent and quash the same as illegal and consequently for a direction, directing the respondents to issue the death certificate of Periyasamy Aasari within the time period stipulated by this Court. O R D E R

This Writ Petition has been filed challenging the impugned order passed by the first respondent dated 21.01.2025 and for a consequential direction, to direct the respondents to issue the death certificate of Periyasamy Aasari within the time period stipulated by this Court.

2.The learned Counsel for the petitioner would submit that the petitioner had applied for death certificate of his great grandfather Periyasamy, who died on 01.07.1972 with all relevant 2/6

documents. But the first respondent has rejected the same vide the impugned order dated 21.01.2025. Hence, the present Writ Petition has been filed.

3.Learned Special Government Pleader appearing for the respondents would submit that the petitioner has not furnished the relevant documents before the respondents and hence, the impugned order came to be passed. He further submitted that in the event of production of the relevant documents, the respondent will consider the request of the petitioner.

4.In reply to the same, learned Counsel for the petitioner would submit that all the necessary documents have already been produced before the respondents.

5.Heard the learned Counsel on either side.

6.The grievance of the petitioner is that the first respondent by virtue of the impugned order has refused to issue death certificate of his great grandfather Periyasamy who died on 01.07.1972. It is the claim of the petitioner that the petitioner has 3/6

already submitted all the relevant documents before the respondents. In such case, the respondent is supposed to have considered all the documents. However, the impugned order came to be passed by the respondent without considering those documents. Therefore, the impugned order is liable to be set aside. Accordingly, the impugned order passed by the first respondent dated 21.01.2025 is set aside and the matter is remanded back to the first respondent for fresh consideration. The petitioner is directed to produce additional documents, if any. On production of the relevant documents, the first respondent is directed to issue the death certificate, subject to the satisfaction of the first respondent. The entire exercise shall be completed within a period of three [3] months from the date of receipt of a copy of this order. 7.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
