O R D E R

The petition is presented on behalf of Balasubramanian by his duly constituted agent C.T.Sivaraj. By relying on the patta in the name of the petitioner's mother Kasthuri and the subsequent patta in the name of the petitioner, the petitioner had applied for survey of 17 ares and 93 square metres in Survey No.1041/51. The present writ petition relates thereto.

2. Mr.P.Thambidurai, learned Government Advocate accepts notice for respondents 1 and 2 and Mr.S.Prakash, learned Government Advocate (criminal side), accepts notice for the third respondent. Learned Government Advocate submits that action would be initiated on the petitioner's request for survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. 2/5

3. Patta in the name of the petitioner's mother and the patta in the name of the petitioner have been submitted. On instructions, learned counsel for the petitioner submits that there is no rival title claim.

4. Considering the above, this writ petition is disposed of by directing the first and second respondents to initiate action on the petitioner's request for survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. The entire process shall be concluded within three months from the date of receipt of a copy of this order. No costs.
