PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS, directing the respondents more particularly the 1st respondent to re-issue Passport to the petitioner based on his application dated 12.09.2025 pending in File No. MD1075626577825 within a time frame. ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent to renew the passport of the writ petitioner based upon his application dated 12.09.2025.

A perusal of the records reveal that the petitioner has been implicated in a criminal case in Cr.No.867 of 2021 on the file of the second respondent which has culminated in filing of the charge sheet in S.C.No.237 of 2023 which is pending on the file of Additional District and Sessions Court, Ramanathapuram. Before the same police station, the petitioner has been implicated in Cr.No.210 of 2024 in which the charge sheet has been laid before the learned Judicial Magistrate Court No.II, Ramanathapuram. However, it has not been taken on file.

3. In view of the above said facts, the petitioner is directed to approach both the trial Courts and seek the prior permission for leaving abroad. Based upon the permission granted by the Court concerned, the first respondent is directed to pass orders in the passport application. 2/4

4. With the above said observations, this writ petition stands disposed of. No costs.
