The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 35 days in filing the appal against the judgment and decree, dated 03.09.2024 in A.S.No.13 of 2021 on the file of the Sub Court, Sattur, confirming the judgment and decree, dated 02.12.2016 in O.S.No.11 of 2012 on the file of the District Munsif Court, Sattur.

2. Heard the learned counsel for the petitioners, learned counsel for the respondent and also perused the records.

3.The learned counsel for the respondent would submit that they are not having objections to allow this petition.

4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
