O R D E R
This Writ Petition has been filed seeking a direction to the 2nd respondent to defreeze the petitioner's primary current bank account bearing No. 10046792022, Bengaluru Branch, Karnataka, forthwith and to permit the petitioner to operate the said account without any hindrance.
2. The learned counsel for the 2nd respondent sought time to file Vakalat. However, the 2nd respondent is permitted to intervene. It is submitted that the account was freezed by the 2nd respondent based on the instructions issued by the 1st respondent.
3. The contention of the petitioner is that a dispute arose between the petitioner's company and one Air Ambulance Company, which provides digital services. In one such case, there was a default in payment, and consequently, the petitioner's account, was frezeed. The amount involved 2/5
in the said transaction is Rs.1,08,000/-.
4. This Court is of the considered opinion that only a sum of Rs.1,08,000/- (Rupees One Lakh and Eight Thousand only) ought to be kept as lien. The petitioner may be permitted to operate the account with respect to the balance amount. Hence, the 1st respondent is directed to issue appropriate instructions to the 2nd respondent to retain a lien / freezing only to the extent of Rs.1,08,000/- in the petitioner's account.
5. With the above directions, this Writ Petition stands disposed of. No costs.
