Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachments made by the respondents 5 to 9 in the Government poramboke water body situated in survey Nos.77 and 72 Paathampatti Village, Kuppakudi Division, Allangudi Taluk, Pudukottai District and restore the said water body to its original condition thereby, considering the representations made by the petitioner on 11.11.2024. Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for the respondents 1 to 3 and the learned Special Government Pleader appearing for the fourth respondent.

2. Issuance of notice to the respondents 5 to 9 is dispensed with.

3. The relief is sought in respect of survey Nos.72 and 77 of Paathampatti Village. The learned Government Advocate states that survey No.72 has been classified as patta land. No relief is granted in respect of the said survey number. Survey No.77 appears to be a water body.

4. The third respondent is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if the encroachments are noticed, then by adhering to due process of law, the encroachments shall be removed. The entire exercise will be completed within a period of four months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
