When this matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent opposed the grant of suspension of sentence that this petitioner, apart from this case, is involved in six other cases of similar nature, out of which, two cases are pending trial.

2. At this juncture, the learned counsel appearing for the petitioner seeks time to ascertain the same and thereafter seeks permission of this Court to withdraw the application. He has also made an endorsement to that effect.

3. In view of the endorsement made by the learned counsel appearing for the petitioner, this Criminal Miscellaneous Petition is dismissed as withdrawn.
