Heard both sides.

2. Settlement deed dated 07.07.2025 was executed by the writ petitioner Jayachandran in favour of his elder son Dhavamani settling his right in the petition-mentioned property. Jayachandran derives title over the property vide partition deed dated 12.02.1987. In the said partition deed, second schedule was allotted to Jayachandran and his son Sankareshwaran. The case of the writ petitioner is that Sankareshwaran was the original name given to his elder son. Subsequently, in the school record, his name was mentioned only as Dhavamani. In view of this discrepancy, registration was refused. Challenging the stand of the registering officer, this writ petition has been filed.

3. In the case on hand, the petitioner is settling his right in the property. It is true that the petitioner was allotted the second schedule in the partition deed dated 12.02.1987 along with his son. The registering authority need not be bothered whether the 2/4

3 W.P.(MD)NO.32619 OF 2025 petitioner's son's name is Sankareshwaran or Dhavamani. Admittedly, the writ petitioner was given share in the property which is being settled by the petitioner to his son. Therefore, the discrepancy with regard to the name is irrelevant. The impugned refusal check slip is quashed. The parties are permitted to re-present the document in question and the same shall be registered and released subject to fulfilment of the other usual formalities. This writ petition stands allowed. No costs.
