Respondents [R4 to R8 are impleaded vide order dated 05.12.2025, made in W.M.P.(MD)No.27369 of 2025] PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein to conduct survey and demarcate four boundaries in respect of the property in S.No.229/9B2, situated at Melathur Village, Alangudi Taluk, Pudukkottai District, with the aid of the second respondent and consequently, direct the respondents 1 and 3 to issue survey reports, within stipulated time fixed by this Court. ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents herein to conduct survey and demarcate four boundaries in respect of the property in S.No.229/9B2, situated at Melathur Village, Alangudi Taluk, Pudukkottai District, with the aid of the second respondent and consequently, direct the respondents 1 and 3 to issue survey reports, within stipulated time fixed by this Court.

2. Heard the learned counsel appearing for the parties.

Today, when the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 and 3 submitted that the respondents 4 to 8 have already approached the District Munsif-cum-Judicial Magistrate Court, Alangudi, Pudukkottai District, and instituted a suit in O.S.No. 39 of 2024.

4. However, the learned counsel for the petitioner submitted that the petitioner is not aware of the said civil proceedings.

5. Considering the facts and circumstances of the case and taking note of the aforesaid submissions, this Court is of the view that since the issues relating to the subject property are presently under adjudication before the Civil Court, it is for the petitioner to implead himself in the said suit and seek appropriate relief in the manner known to law.

6. With the above observation, this Writ Petition stands disposed of. There shall be no order as to costs.
