PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to survey petitioner's land being in S.No. 1384/2C2B situated at Sundrapandiam Village, Vathirairuppu Taluk, Virudhunagar District based on the petitioner's application dated 26.07.2025 within stipulated time fixed by this Court. ORDER

By relying on sale deed dated 24.11.1997 in the name of petitioner's father and Will dated 14.06.2005 bequeathing a portion of the land in S.No. 1384/2C, the petitioner had applied for survey of the land.

2. Learned counsel for the petitioner submits that the petitioner obtained a joint patta pursuant to the Will. Therefore, he submits that the petitioner is entitled to get the property surveyed.

3. Learned Special Government Pleader accepts notice for the first respondent. He points out that the extent mentioned in the sale deed in favour of the petitioner's father is 1 acre. He also submits that the extent bequeathed under the Will appears to be 2.72 cents. He submits that an inquiry would be conducted after issuing notice to owners of relevant adjacent land, including the second respondent.

4. In view of the above submissions of learned Special Government Pleader, it is not necessary to issue notice to the second respondent in this writ petition. Instead, this writ petition is disposed of by directing the first respondent to conduct an inquiry in relation to the petitioner's request for survey 2/4

after issuing notice to owners of relevant adjacent lands, including the second respondent herein and to the other legal heirs of the petitioner's father Gopal Samy. Objections, if any, from the said persons shall be taken into account before a speaking order is issued. Such order shall be issued within three months from the date of receipt of a copy of this order.
