Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the first and second respondents to survey the land and to fix the four boundaries and measure of the petitioner's property in Patta No.2445 in old Survey.No.347/5A, New Survey No. 347/5A1A with extent of 5 cents which is located in Melavalavu village, Melur Taluk Madurai District, based on the online application No. 2025/0123/24/020413 dated 23.09.2025 along with representation submitted by the petitioner on 31.10.2025.

By relying on a sale deed dated 23.02.1983 in favour of the petitioner's father and patta No.2445, the petitioner had applied for a survey of land in survey No.347/5A1A of an extent of 5 cents. The present Writ Petition relates thereto.

2. Learned Additional Government Pleader accepts notice for both the respondents. After pointing out that patta No.2445 stands in the names of Mani, Periyakaruppan and the petitioner, he submits that notice would be issued to the joint pattadars and objections, if any, from them would be considered before a decision is taken.

3. Patta No.2445 is in respect of survey No.347/5A1A of an extent of 9.28 ares, which is about 22 cents. The petitioner's father has purchased about 5 cents in the said survey number. Therefore, it is necessary to issue notice to the joint pattadars. It is also necessary to issue notice to owners of relevant adjoining lands. Objections, if any, from these persons should be taken into account before a decision is taken.

Subject to the above observations, this Writ Petition is disposed of by directing the respondents to initiate action on the petitioner's request for a survey after issuing notice to the persons mentioned in the previous paragraph. Objections, if any, from the above persons shall be taken into account before a decision is taken. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
