survey stones with aid of the third Respondent police in S.F.No.221/1B2 with an extent of 67 cents situated at Panankulam Village, Alangudi Taluk, Pudukkottai District based on the Petitioner's online application dated 02.06.2025 within a time stipulated by this Court. O R D E R

By relying on a sale deed dated 22.10.1990 and patta No.2312, the petitioner had applied on 02.06.2025 for a survey of 27 ares in survey No.221/1B2. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner submits that survey notice was issued on two occasions earlier, but that the survey was not conducted. He also states that respondents 4 and 5 are not connected to the property, but that they raised objections. 2/5

3. Learned Government Advocate accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent. Learned Government Advocate submits that notice would be issued to owners of adjoining lands and to the fourth and fifth respondents. Before taking a decision, he states that their objections, if any, would be considered.

4. In view of the above submissions of learned Government Advocate, it is unnecessary to issue notice to the private respondents in this Writ Petition. Instead, this Writ Petition is disposed of by directing the first and second respondents to conduct an inquiry in relation to the petitioner's request for a survey after issuing notice to owners of relevant adjacent lands and to the fourth and fifth respondents herein. Objections, if any, from the said persons shall be taken into account before a decision is taken.

5. For avoidance of doubt, it is clarified that the survey shall not be undertaken if there is a credible title dispute, whereas boundary disputes may be decided by the first and second respondents. If necessary, revenue 3/5

officials may avail the assistance of the jurisdictional police. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
