An order dated 02.01.2017 of the second respondent is challenged in this Writ Petition.
2. Learned counsel for the petitioners states that the properties forming the subject of the assignment were purchased by the petitioner under several sale deeds executed in the year 2007. He also submits that the sale in favour of the petitioner was made several years after the assignment was made. He points out that the assignment was made on or about 02.05.1980. Although an appeal was filed before the District Revenue Officer challenging the order dated 02.01.2017, he states that no action was taken thereon till date. He also relies upon the earlier order dated 20.03.2025 of this Court in W.P.(MD) No.2065 of 2023 and related cases.
3. Learned Special Government Pleader accepts notice for all the 2/5
respondents. He submits that the District Revenue Officer is awaiting a report from the Sub Collector and that the appeal would be disposed of within three (3) months.
4. The petitioner had challenged the order dated 02.01.2017 in 2018. The said appeal has not been disposed of till date. Therefore, it is just and necessary that such appeal be disposed of expeditiously.
5. Accordingly, this Writ Petition is disposed of by directing the first respondent to consider and dispose of the petitioner's appeal within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and any other person who would be affected by the order. While disposing of the appeal, the District Revenue Officer shall take note of the order dated 20.03.2025 in W.P.(MD) No.2065 of 2023 and related cases. No costs. W.M.P.(MD) No. 25859 of 2025 is allowed. Consequently, connected miscellaneous petitions are closed.
