2.The case of the prosecution is that on 15.12.2024, the defacto complainant received a sum of Rs.5,000/- from the petitioner and thereby, on 16.12.2024, the petitioner picked up the defacto complainant in his car and brought her to his office and forcibly physical relationship with her. Thereafter, the petitioner threatened her not to reveal the said incident. Hence, the case.

3. The learned counsel for the petitioner would submit that the defacto complainant had borrowed money from the petitioner and when the 2/8

petitioner asked the defacto complainant to return the amount, a false case has been foisted against the petitioner. He would further submit that the petitioner is an innocent person and he is no way connected in the above said incident. He would further submit that the alleged occurrence took place on 16.12.2024, however the date of FIR is on 01.07.2025 and hence, there is a delay in filing FIR. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that there was a money dispute between the parties and hence, the present has been filed against him. He would further submit that the investigation is pending and the offences are grave in nature. He fairly submits that the petitioner has no previous cases. However, he opposes to grant anticipatory bail to the 3/8

petitioner.

5. Heard both sides and perused the materials available on record.

6.Considering the rival submissions on either side and nature of offence and considering the fact that there was a money dispute between the parties and the alleged occurrence took place on 16.12.2024, however the date of FIR is on 01.07.2025 and hence, there is a delay in filing FIR and no previous case is pending against the petitioner and hence, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions:

[a] Accordingly, the petitioner is ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand 4/8
