Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records of the second respondent relating to the Impugned Order issued in No. Na.Ka.No.R3/0234/2013 dated 20.02.2013 and quash the same and consequently direct the first respondent to appoint the petitioner in any one of the posts applied for the petitioner according to the cut off marks criteria fixed for SC(A).

ORDER

It has been brought to the notice of this Court that as per the notification for recruitment to the post of Gr.II Police Constable, it is clarified that when the marks obtained by the candidates are equal, then the date of birth of the candidates will be taken into account for determining the selection. In view of the above condition, the writ petitioner was not selected. Thus, there is no infirmity and accordingly, no further adjudication is required, in respect of other grounds raised in this writ petition.

2. Accordingly, writ petition stands dismissed. However, there shall be no order as to costs. Consequently, MP(MD)No.1 of 2013 is closed.
