Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the second respondent herein to register a sale deed pending as No.5 of 2013 in pursuant to the Civil Court decree in O.S.No.440 of 2012 dated 04.09.2012 on the file of Sub Court, Melur and release the same to the petitioner within a stipulated time fixed by this Court.

O R D E R

The Writ Petition has been filed for a Mandamus directing the second respondent to register a sale deed pending as No.5 of 2013 in pursuant to the Civil Court decree in O.S.No.440 of 2012 dated 04.09.2012 on the file of Sub Court, Melur and to release the same to the petitioner within a stipulated time.

2. The writ petition has been filed to release the sale deed and at that point of time, it was not released, since the patta has not been produced.

3. During the pendency of the writ petition, the petitioner has now been alloted a Patta, on which a copy of the same has been produced. He is now willing to produce the same before the authority concerned. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate would submit that if it is produced in accordance with law, they will pass appropriate orders.

5. In view of the subsequent development, especially the grant of Patta in the name of the vendor, the petitioner will produce the same before the second respondent and on such submission, the second respondent will verify the same and pass appropriate orders within a period of two months from the date of receipt of a copy of this order. With the above direction, the Writ Petition stands disposed of. No costs.
