O R D E R

This writ petition has been filed for the issuance of a Writ of Mandamus directing the respondents 1 to 3 to conduct an inquiry and pass appropriate orders on the petitioner's application for cancellation of 2/6

the patta in Patta Nos. 698, 1617, 3612, 3613, 3614, 3615, and 3764, which stand in the names of respondents 4 to 14, in respect of the property situated in Alagampatti, Jambuthuraikottai Village, Nilakottai Taluk, Dindigul District, by considering the petitioner's application dated 05.11.2025 within the period stipulated by this Court.

2. Learned counsel for the petitioner submitted that the petitioner's father purchased the subject properties through registered sale deeds dated 06.04.1966 and 13.09.1972. Due to old age, the petitioner's father executed an unregistered power of attorney in the petitioner's name. Learned counsel for the petitioner further alleged that the respondents 4 to 14 obtained patta in respect of the subject properties without any title documents. Aggrieved by this, the petitioner submitted a representation before the respondents seeking the cancellation of the patta issued in favour of the private respondents 4 to 14 for the subject property. However, the said representation has not been considered so far, and therefore, the present writ petition has been filed by the petitioner.

3. Per contra, learned counsel appearing for respondents 7 to 14 submitted that for the same cause of action, the petitioner's father had 3/6

submitted a representation earlier, which has already been considered and rejected by the second respondent by order dated 16.04.2025. After the disposal of the said representation, the petitioner again filed another representation with the same grievance, seeking the cancellation of the patta in favor of the private respondents. Hence, the petitioner ought to have approached the civil court. However, the petitioner has chosen to file the present writ petition.

4. At this juncture, learned counsel for the petitioner submitted that the petitioner seeks liberty to agitate the issue before the competent civil court.

5. In view of the aforesaid submissions, this writ petition stands disposed of granting liberty to the petitioner to approach the competent civil court to redress his grievances. No costs. (K.SURENDER, J) 10.02.2026 NCC :Yes/No Internet :Yes/No Index :Yes/No PKN 4/6
