Heard both sides.

2. The petitioner is permitted to re-present the document in question. The second respondent will take a call as to whether to register or not. He will not be guided by the fact that the third respondent had called upon the second respondent not to register the document. I have held in dozens of cases that the revenue authority cannot call upon the registering authority to not to register the document in question. The statutory authority has to discharge the statutory function in the manner laid down in the statute. The Tahsildar has no jurisdiction to issue any direction as such to the second respondent.

3. With the aforesaid clarification of the legal position, this writ petition stands disposed of. No costs.
