O R D E R

By relying on sale deed dated 13.10.2010, the petitioner had applied for subdivision and grant of patta in respect of land in Survey No. 205/2 of the extent of three and a half cents. The present writ petition relates thereo.

2. Learned Special Government Pleader accepts notice for all the respondents. On the basis of written instructions, he submits that land in old Survey No.52 is classified as 'Sarkar Manai' and that notice under Section 7 of the Tamil Nadu Land Encroachment Act 1905, has been issued to the petitioner in respect thereof. He submits further that the present writ petition has been filed solely to prevent further action for removal of encroachment.

3. Given the fact that the land is classified as 'Sarkar Manai' as per the revenue records, the request of the petitioner cannot be countenanced. Therefore, this writ petition is dismissed without any order as to costs. 2/4

This order will not stand in the way of any proceedings being initiated by the petitioner in respect of the action taken under the Tamil Nadu Land Encroachment Act, 1905.
