Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS directing the Respondents to pay interest at the rate of 12 percentage per annum, for the period of delay from the date of demise of petitioners husband in service 1/4
(01.11.2023) to till the date of reimbursement (25.08.2025) of amount paid towards petitioners husband terminal and pension benefits namely EPF Employees Contribution, Gratuity and Encashment of Earned/Sick Leave, within a time frame as may be fixed by this Hon'ble Court, without affecting the petitioners right to claim balance amounts towards those benefits and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice. ORDER
This writ petition has been filed for a Writ of Mandamus directing the Respondents to pay interest at the rate of 12 percentage per annum, for the period of delay from the date of demise of petitioners husband in service (01.11.2023) to till the date of reimbursement (25.08.2025) of amount paid towards petitioners husband terminal and pension benefits namely EPF Employees Contribution, Gratuity and Encashment of Earned/Sick Leave, within a time frame as may be fixed by this Hon'ble Court, without affecting the petitioners right to claim balance amounts towards those benefits.

2. Considering the admitted fact that there has been a delay in payment, the petitioner is entitled to statutory interest as provided under law.
3. In view of the same, the writ petition stands disposed of. The respondents are directed to pay interest at the rate of 6% per annum on the belated terminal benefits payable to the petitioner from the date of his entitlement till the date of his payment within a period of 12 weeks from the date of receipt of a copy of this order.
