Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS, to direct the 2nd and 3rd respondents to revise the pay, pension and other retirement benefits payable to the petitioners herein by re-designating them as Selection Grade Superintendents so as to enable them to receive the Selection Grade Superintendent time scale of pay of Rs.7500-250-12500 1/4

with effect from 01.01.2008 and the revised scale of pay (as per 6th Pay Commission) of Rs.9300-34800 Plus Grade pay Rs. 4900 with effect from 01.04.2015 and to pay the difference in salary and the difference in retirement benefits from 01.05.2017 within the time that may be stipulated by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

O R D E R

This writ petition has been filed seeking direction to the 2nd and 3rd respondents to revise the pay, pension and other retirement benefits payable to the petitioners herein by re-designating them as Selection Grade Superintendents so as to enable them to receive the Selection Grade Superintendent time scale of pay of Rs.7500-250-12500 with effect from 01.01.2008 and the revised scale of pay (as per 6th Pay Commission) of Rs.9300-34800 Plus Grade pay Rs. 4900 with effect from 01.04.2015 and to pay the difference in salary and the difference in retirement benefits from 01.05.2017.

2. Even though the petitioner was superannuated on 30.04.2017, he had not been benefited with the Government Order in G.O.Ms.No. 146, Transport (C) Department dated 30.11.2015. In that regard, the petitioner has also submitted his representation on 13.08.2025. But, however, his representation has not been considered by the authorities.

3. In view of the same, the 2nd and 3rd respondents are directed to consider the representation of the petitioner dated 13.08.2025 by applying the G.O.Ms.No.146, Transport (C) Department dated 30.11.2015 and revise the eligible pay scale of the petitioner together with 6% interest for the belated payment. The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.

4. The writ petition stands disposed of with the above directions. No costs.
