Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to return the licensed gun of petitioner's husband after defusement to keep the same as memento of his service to the Nation by considering her representation dated 25.10.2025.

ORDER

This Writ Petition is filed for Mandamus to direct the respondents to return the licensed gun of petitioner's husband after deactivating the gun to keep the same as memento of his service to the Nation by considering her representation dated 25.10.2025.

2. It is the case of the petitioner that her husband had a licence to possess a firearm; that during election, he surrendered the said firearm and before taking the return of the firearm, he passed way; that though the petitioner is entitled to apply for licence as a legal heir to possess the firearm and take back the pistol, she intends to only take back the deactivated firearm to keep it as a memento and therefore sent a representation to the respondents.

3. The learned Government Advocate and the learned Additional Public Prosecutor appearing for the respondents would submit that the petitioner's representation dated 25.10.2025 would be considered in accordance with law and appropriate action would be taken within a period of four weeks.

4. In view of the above submission, without expressing any opinion on the merits of the claim made by the petitioner, this Court directs the respondents 2/4

to consider the petitioner's representation dated 25.10.2025 and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
