Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the respondents Police 3 to 5 not to harass the petitioner under the guise of enquiry without due process of law.

ORDER

This Criminal Original Petition is filed to direct the respondents 3 to 5 not to harass the petitioner under the guise of enquiry without due process of law.

2. The learned Additional Public Prosecutor, on instructions, would submit that there is no complaint pending against the petitioner on the file of the third respondent; that however, there are five cases, which are pending investigation on the file of the fifth respondent; and that the respondents are not harassing the petitioner, but watching the movements of the petitioner.

3. In view of the above submission, it is open to the respondents to issue summons to the petitioner and on such summons, the petitioner shall appear before the respondents.

4. With the above observations, this Criminal Original Petition stands disposed of.
