O R D E R

This Criminal Original Petition has been filed seeking to quash the final report in C.C.No.410 of 2023 on the file of the learned Judicial Magistrate, Alangulam, Tenkasi District, filed against the petitioners for the offences punishable under Sections 294(b), 324 & 326 of the Indian Penal Code, 1860 and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002.

The gist of the allegations in the final report is that, on account of a prior dispute, the petitioners, who are the brothers of the second respondent/defacto complainant, attacked the second respondent/defacto complainant with their hands and a stick and abused her in filthy language, and thus committed the aforesaid offences.

3. Admittedly, the petitioners and the second respondent/defacto complainant are brothers and sister. They have now entered into a compromise and decided to give a quietus to the entire dispute. They have filed a joint compromise memo dated 6th November, 2025. Page No. 2 of 5

The petitioners, namely, (1) Anthony Raj [Aadhaar No.2413 4083 5139] and (2) Backiya Raj [Aadhaar No.5961 3888 5727] and the second respondent/defacto complainant, namely, Mary [Aadhaar No.9923 2065 3192] are present before this Court in person. The parties are identified by Mr.David, Special Sub-Inspector of Police, V.K.Pudur Police Station, Tenkasi District. The second respondent/defacto complainant confirmed the compromise arrived at between them and stated that she does not wish to pursue the case.

5. In view of the same and considering the nature of the offences, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in C.C.No.410 of 2023, on the file of the learned Judicial Magistrate, Alangulam, Tenkasi District, is quashed. The petitioners shall jointly pay a sum of Rs.10,000/- (Rupees Ten Thousand only) to the Siddha Unit attached to this Court (A/c. No.10767823177, IFSC Code : SBIN0000898 & MICR Code : 625002601) forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The compromise memo filed by the parties shall form part and parcel of this order.
