Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 1 and 2 to consider the representation of the petitioner dated 22.02.2013 and 18.03.2013 in accordance with law within time stipulated by this Court and thereby to pay the arrears of rent payable to the petitioner on the basis of the fair rent fixed by the fifth respondent every month without any default.

ORDER

This writ petition is filed seeking a writ of Mandamus to direct the respondents 1 and 2 to pay the arrears of rent payable to the petitioner on the basis of the fair rent fixed by the fifth respondent and based on his representations, dated 22.02.2013 and 18.03.2013, within the time stipulated by this Court. 2.Heard both sides.

3.The petitioner made two representations dated 22.02.2013 and 18.03.2013, to the respondents 1 and 2, seeking to pay the arrears of rent payable to the petitioner, on the basis of the fair rent fixed by the fifth respondent, for his buildings in Door Nos.3/611 and 4/612, which were given on rental basis, for functioning of Police Station.

4.The learned Government Advocate appearing for the respondents would submit that the buildings had already been vacated and possession was handed over to the petitioner. 5.Recording the said statement made on the side of the respondents, the writ petition is closed, directing the respondents 1 to 2 to settle the arrears of rent, if any, to the petitioner, otherwise, the petitioner shall approach the competent civil Court, if so advised. No costs. Consequently, connected Miscellaneous Petition is closed.
