PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to survey the land situated in S.No.9/3A with an extent of 18 cent Viraganoor Village, Madurai South Zone, Madurai District. ORDER

By relying on sale deed dated 23.01.1941, partition deed dated 27.08.1960 and patta No.155, the petitioner had applied for survey of 18 cents in S.No.9/3A.

2. Learned counsel for the petitioner submits that an earlier writ petition was filed in W.P.(MD)No.16524 of 2025. He also points out that the said writ petition was disposed of by directing the consideration of the request for survey. He, however, submits that the survey could not be conducted because some necessary parties had not been impleaded in the said writ petition. He submits further that all necessary parties have been included in this writ petition.

3. Learned Government Advocate accepts notice for the respondents 1 and 2. He submits that an inquiry would be conducted by issuing notice to the petitioner and all the private respondents herein before a decision is taken. 2/4

Accordingly, without expressing any opinion on the merits, this writ petition is disposed of by directing the first and second respondents to conduct an inquiry in relation to the petitioner's request for survey after issuing notice to the petitioner and the private respondents herein. After considering objections, if any, from the private respondents, a speaking order shall be issued within three months from the date of receipt of a copy of this order. No costs.
