ORDER
The petitioners, who were arrested and remanded to judicial custody on 13.05.2025 for the offences punishable under Sections 8(c), 20(b)(ii)(c) and 25 of NDPS Act, in in C.C.No.137/2025 pending on the file of the Additional District Judge for Special Court Under Essential Commodities Act, Thanjavur, seeks bail.
2.The case of the prosecution is that the respondent police seized 20 kg of ganja. Hence, this case.
3. The learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. However, they have been arrested and they have been languishing in jail from 13.05.2025. Therefore, he prays for grant of bail.
4. The learned Additional Public Prosecutor appearing for the respondent police opposed for grant of bail on the ground that the investigation is still pending. Further, the 1st petitioner / A7 has 14 previous cases against him among which 7 are NDPS cases and the 2nd petitioner / A5 has 32 previous cases against him among which 9 are NDPS cases.
5.The learned appearing for the petitioners further submitted that totally, there are 15 accused and 11 accused were already granted bail. Therefore, the petitioners are seeking to be put on the par with the other accused and to be granted bail. 6.Further, the learned Additional Public Prosecutor appearing for the respondent circulated a video wherein it is stated that one of the petitioners is threatening the police officials. They have indulged in threatening the school children who were used for selling the contraband. When the school children had not repaid the amount and
had not submitted the accounts properly, the school children were threatened by the petitioners. The selling contraband to end user has occurred in the present case. Therefore, the petitioners cannot be granted bail.
7. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioners, this Court is not inclined to grant bail to the petitioner at this stage.
