ORDER

The petitioner's father died on 08.07.1995 while in service as Grade-I Police Constable in Perungudi police station; at that point of time, the petitioner was aged only 10 years; therefore, the petitioner's mother applied for appointment on compassionate grounds; subsequently, there had been a dispute among the legal heirs as to who is entitled to get the appointment after the death of the petitioner's father; this was resolved in C.M.A.No.26 of 2005 on the file of the Additional District Judge, Madurai, in which, a compromise was entered into between the parties, whereunder, all the legal representatives agreed that the petitioner is entitled to make a claim for appointment on compassionate grounds; the petitioner's mother Nagammal died on 13.12.2011; the petitioner sent a representation dated 02.07.2012 seeking compassionate appointment and the 1st respondent by communication dated 31.07.2012, has informed the petitioner that her case is in the waiting list of Junior Assistant at Serial https://hcservices.ecourts.gov.in/hcservices/

No.2175 and she would get the job as and when her turn comes. Therefore, the eligibility of the petitioner to get appointment on compassionate grounds is not under dispute.

2.Under such circumstances, the respondents are directed to appoint the petitioner in the post of Junior Assistant as and when her turn comes.

With the above direction, this Writ Petition is disposed of. No costs.
