PRAYER : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to call for the records in connection with C.C.No.119 of 2025 on the file of the learned District Munsif cum Judicial Magistrate, Ottapidaram, Thoothukudi District in connection with Crime No.39 of 2024 on the file of the 1st respondent and subsequently quash the petitioners as illegal. ORDER
This Criminal Original Petition is filed to quash the impugned final report in C.C.No.119 of 2025 on the file of the learned District Munsif cum Judicial Magistrate, Ottapidaram, Thoothukudi District, which was filed for the offences under Sections 147, 148, 294(b), 506(2), and 352 of IPC r/w. Section 4 of TN Prohibition of Harassment of Women Act, 2002.
2. The allegation in the final report is that on account of a love affair, the petitioners attacked the de-facto complainant and thus, committed the aforesaid offences.

3. The learned counsel for the petitioners would submit that the parties have now arrived at a compromise and have filed a joint compromise memo dated 13.11.2025.
4. The petitioners and the 2nd respondent/de-facto complainant are present before this Court in person. They are identified by Mr.M.Paramasivan, Special Sub Inspector of Police, Tharuvaikulam Police Station, Thoothukudi District. All the parties confirmed the compromise arrived at between them.

Considering the nature of the allegations against the petitioners and in view of the compromise arrived between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in C.C.No.119 of 2025 on the file of the learned District Munsif cum Judicial Magistrate, Ottapidaram, Thoothukudi District, is quashed and this Criminal Original Petition stands allowed. The petitioners shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) each as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo 3/5
reporting compliance in the Registry. The joint compromise memo dated 13.11.2025 shall form part of this order.
