PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the order passed by the second respondent in his proceedings Na.Ka.No.6871/2020/A4 dated 27.10.2022 and quash the same as illegal, consequently directing the second and third respondent to issue patta for the land measuring to an extent of 53 cents out of 10 acre and 60 cents, comprised in Survey No.621/1 situated at Panrimalai Village, Dindigul West, Dindigul District in petitioners name. O R D E R

This Writ Petition has been filed seeking to quash the order passed by the second respondent in his proceedings Na.Ka.No. 6871/2020/A4 dated 27.10.2022 and to consequently direct the second and third respondents to issue patta for the land measuring to an extent of 53 cents out of 10 acre and 60 cents, comprised in Survey No.621/1 situated at Panrimalai Village, Dindigul West, Dindigul District in the petitioner's name.

2.With the consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3.Since no adverse orders are going to be passed against the respondents 4 to 6, notice to the respondents 4 to 6 is hereby dispensed with.

4.The order impugned is dated 27.10.2022, whereby the appeal for transfer of patta which was received from the petitioner was refused on the ground that there is a second appeal pending before this Court in S.A.(MD)No.30 of 2018.

5.Today, when the matter is taken up for hearing, it is informed that the said Second Appeal was dismissed as abated on 10.06.2025.

6.In view of the above, the petitioner is at liberty to give a fresh representation to the second respondent for redressal of his grievance. On such representation being made, the second respondent to directed to dispose of the said representation on merits and pass appropriate orders in accordance with law, after 3/6

giving due opportunity to the petitioner, respondent s 4 to 6 as well as all other persons, who may be interested in the subject matter, within a period of twelve [12] weeks from the date of receipt of the said representation. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to consider the same on its own merits.

7.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
