ORDER
Today, this Criminal Original Petition is listed under the caption, 'for Page No.1 of 8
being mentioned' at the instance of the learned counsel for the petitioner.
2. The learned counsel appearing for the petitioner would submit that though this Court in the order dated 18.11.2025 had observed that the petitioner has been charged for the offence under Sections 279 and 304-A of I.P.C, the offence has been wrongly stated as Section 302 of I.P.C in the order and that this Court had also directed the trial Court to conclude the trial within a period of four months, but in the order copy it is mentioned as if the trial has to be concluded as expeditiously as possible.
3. The learned Government Advocate confirms the above facts.
4. In view of the aforesaid submission, paragraph No.2 of the order dated 18.11.2025 made in Crl.O.P (MD) No.20492 of 2025, shall read as follows:
"2. Considering the above, this petition is dismissed as withdrawn. The personal appearance of the petitioner before the Trial Court is dispensed with (provided he is represented by a lawyer) unless his appearance is required by the Page No.2 of 8
learned Magistrate for the progress of the trial. Since the offences are under Sections 279 and 304-A of I.P.C., the learned Magistrate shall dispose of the trial within a period of four months from the date of receipt of a copy of this order. Consequently, connected Miscellaneous Petitions are closed."
5. Registry is directed to make the necessary corrections and issue a fresh order copy, forthwith.

When this Court expressed that the points raised by the petitioner are factual in nature, the learned counsel for the petitioner prayed to withdraw the petition and he also made an endorsement to that effect. However, he would submit that the petitioner is working in Bangalore and hence, the appearance of the petitioner before the trial Court may be dispensed with.
2. Considering the above, this petition is dismissed as withdrawn. The personal appearance of the petitioner before the Trial Court is dispensed with (provided he is represented by a lawyer) unless his appearance is required by the learned Magistrate for the progress of the trial.
