herein to remove the illegal encroachment of public pathway made by the respondents 4 to 7 in Sy.Nos.93/21 and 93/31, Usilampatti Village, Manapparai Taluk, Tiruchirappalli District as per the proceedings of the 2nd respondent dated 15.09.2025 and the 3rd respondent dated 25.07.2025 and 04.08.2025 respectively within a reasonable time frame stipulated by this Court.

ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) The petitioner is aggrieved by the inaction of the official respondents ie., R1 to R3 in removing the encroachments caused by R4 to R7 on a public pathway in Survey Nos.93/21 and 93/31, Usilampatti Village, Manapparai Taluk, Tiruchirappalli District. 2.Mr.M.Sarangan, learned Additional Government Pleader accepts notice for R1 to R3 and in light of the submissions made, we are inclined to dispose the Writ Petition even at the stage of admission. We also see no necessity to issue notice to R4 to R7/private respondents. 2/5
3.Mr.Sarangan, draws attention to the proceedings initiated under the Tamil Nadu Land Encroachment Act, 1905 (in short 'Act') as against R4 to R7. A notice under Section 7 of the aforesaid enactment was issued on 04.08.2025 (erroneously referred to as 04.08.2024 in the notice), followed by an order under Section 6 of the Act on 15.09.2025. 4.The grievance of the petitioner and the reasons for seeking a Mandamus is that the authorities are not proceeding with the matter with the expected diligence and speed.
5.Mr.Sarangan, however, assuages the apprehensions of the petitioner by stating that the authorities were held up on account of other administrative duties and that they would attend to the consequential statutory action expeditiously, within a period of two weeks from the date of receipt of a copy of this order.
6.Recording the same and since the Mandamus now stands achieved, this Writ Petition is closed. No costs. [A.S.M.J.,] & [C.K.J.,] 21.11.2025 NCC :Yes/No Index :Yes/No ps 3/5
