Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to proceedings Na.Ka.A5/21510/2020 dated 24.01.2023 of the 2nd respondent and set aside the same and direct the respondents to reinstate the petitioner in his service with all other monetary benefits and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice. 1/4

ORDER

This writ petition is filed challenging the proceedings Na.Ka.A5/21510/2020 dated 24.01.2023 of the 2nd respondent and seeking consequential direction to the respondents to reinstate the petitioner in his service with all other monetary benefits.

2. The order of suspension had been made on the ground that the petitioner had been detained under custody for more than 48 hours for the offence committed by him under Vigilance and Anti-Corruption Act in Crime No.3 of 2020, against which, the petitioner had filed an appeal and he has also been enlarged on bail. The order of suspension was made on 04.08.2020 and therefore such order of suspension is liable to be reviewed as per Government Order in G.O.Ms.No.81, Human Resources Management Department, dated 04.08.2022.

In such view of the matter, the writ petition stands disposed of with a direction to the 1st respondent to review the order of suspension dated 04.08.2020 with reference to the Government Order in G.O.Ms.No.81, Human Resources Management Department, dated 04.08.2022. The said exercise shall be carried out within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
