Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus calling for the records relating to the Government letter No.5626/G2/20104 dated 20.06.2011 issued by the first respondent and quash the same and direct the respondents to allow the petitioner to retire from service on attaining the age of 60 years as per FR 56(i). ORDER

The claim of the writ petitioner is that they must be allowed to serve till they attain the age of 60 years. However, it is brought to the notice of this Court that the Government itself has considered the case of similarly placed persons that of the petitioner and issued orders in G.O.(Ms)No.124,Handlooms, https://hcservices.ecourts.gov.in/hcservices/

Handicrafts, Textiles & Khadi (G1) Department, dated 03.05.2017 and the retirement age of certain cadre of employees are fixed as 60 years. Thus the case of the writ petitioner also to be considered in the light of the said G.O.(Ms)No.124, Handlooms, Handicrafts, Textiles & Khadi (G1) Department, dated 03.05.2017. In this regard, the writ petitioner is permitted to submit a fresh representation along with the copy of the Government order issued on 03.05.2017, within a period of three weeks from the date of receipt of a copy of this order. If any such representation is received then the second respondent is directed to consider the representation on merits and in accordance with law and pass orders within a period of 12 weeks thereafter.

2. Accordingly, this writ petition stands disposed of. Consequently, connected miscellaneous petitions are closed. No costs.
