ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 409, 420, 477(A) of IPC corresponding Sections 316(5), 318(4) and 344 of BNS, 2023, in Crime No.162 of 2015, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner received a deposit amount from one Chinnammal on 06.12.2013, however, the said amount was not remitted to the Government account. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent Police submits that the is a case of jumped bail. He further submits that the petitioner received a deposit amount from one Chinnammal on 06.12.2013, however, the said amount was not remitted to the Government account.

5. Considering the fact that the petitioner has jumped bail, this Court is directing the petitioner to surrender before the concerned Judicial Magistrate Court and file a recall application. On such application, the learned Judicial Magistrate shall consider the same in accordance with law on merits on the same day.

6. With the above said directions, this Criminal Original Petition is disposed of.
