Heard both sides.

2. The petitioner is running a crusher unit. An adverse order dated 10.09.2025 was passed against the writ petitioner. It is seen that the report of the spot inspection team that is referred in the impugned order was not furnished to the writ petitioner. This is the violation of principles of natural justice. Any relied on document should be furnished to the noticee before passing order. In any event, it was not furnished by the inspection team. There has been violation of principles of natural justice.

3. On this ground, the order impugned in the writ petition is set aside. The matter is remitted to the file of the third respondent. The third respondent shall serve a copy of the said report on the writ 2/5

3 W.P.(MD)NO.33043 OF 2025 petitioner. The petitioner will be given four weeks to respond. Thereafter, after holding the enquiry, it is open to the third respondent to pass order afresh on merits and in accordance with law. I make it clear that I have not gone into the merits of the matter. Since the impugned order has been quashed and the matter has been remanded to the file of the fourth respondent, the fourth respondent shall issue transit pass subject to production of the relevant records. The fourth respondent cannot withhold such issuance on an untenable ground. This writ petition stands allowed accordingly. No costs.
