Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF MANDAMUS directing the respondent to pay the amount towards the encashment of 71 days of earned leaves surrendered by Petitioner in the years from 2010 before Petitioner retirement either based on Petitioner monthly wages of the respective months of surrender of those earned leaves and 20 days of medical leaves together with 18 percentage interest p.a. from the respective due dates or based on the monthly wage payable on the month of Petitioner retirement, together with 18 percentage interest from the date Petitioner retirement within a time frame as may be fixed by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in nature and circumstances of the case and thus render justice.

ORDER

The present Writ Petition has been filed by a retired employee of the respondent Transport Corporation, seeking a Mandamus for disbursement of the surrender leave salary along with interest.

2. Though the petitioner has retired from service on 30.06.2023, the surrender leave salary has not been disbursed to the writ petitioner, despite giving representation to the respondents on 07.12.2023, for disbursing the said benefits. Since the representation has not been considered, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents. 2/4

Considering the above said facts, the respondent herein is directed to release the eligible surrender leave salary to the writ petitioner along with interest at the rate of 6% per annum, from the due date till the date of disbursement, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
