Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the Respondent No.1 to survey, demarcate and determine the boundary of petitioner's agricultural land in Survey No.268/3C total extent 42 Ares (1 acre 3 cents) patta No.2165 and Survey No.268/9A total extent 12 Ares(30 cents) and Survey No.268/10A total extent 29 Ares(72 cents) patta No.2164 situated at Vikkiramangalam Village, Usilampatti Taluk, Madurai District, based on petitioner's application No. 2025/0123/24/021439 dated 03.11.2025 and permit the petitioner to video graph the entire survey proceedings and consequently, direct the third respondent to give a police protection. 1/5

O R D E R

By relying on a sale deed dated 15.11.2005 and patta Nos.2165 and 2166, the petitioner had applied online in November 2025 for the survey of lands in survey Nos.268/3C (50 cents), 268/10A (72 cents) and 268/9A (30 cents). The present Writ Petition relates thereto.

2. Learned Government Advocate accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent. Learned Government Advocate submits that notice would be issued to the joint pattadars under patta No.2165 before taking a decision.

3. As regards survey Nos.268/10A and 268/9A, a separate patta stands in the name of the petitioner. On the contrary, as regards the 2/5

survey No.268/3C, the petitioner has purchased a smaller extent of 50 cents from and out of 1 acre and 4 cents. Therefore, it is necessary to issue notice to the joint pattadars under patta No.2165 and consider objections, if any, from them before a decision is taken. It is also necessary to issue notice to owners of relevant adjacent lands and consider their objections.

4. Subject to the above observations, this Writ Petition is disposed of by directing the first and second respondents to initiate action on the petitioner's request for a survey after issuing notice to the persons mentioned in the previous paragraph. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
