By relying on a patta No.83 in the name of the petitioner's motherin-law, Guruvammal, the petitioner had applied for a survey of the land in survey No.290/26.

Learned counsel for the petitioner submits that the petitioner's mother-in-law passed away on 16.07.2021 and that the only surviving Class-I legal heirs are her husband, Muthaiah and her brother-in-law, Elangovan. He also submits that there is no rival title claim and that the brother-in-law lives separately with his family.

3. Learned Additional Government Pleader accepts notice for both the respondents. He submits that a notice would be issued to the legal heirs of the petitioner's mother-in-law, Guruvammal and to owners of relevant adjacent lands before a decision is taken.

4. In these circumstances, this Writ Petition is disposed of by directing the respondents to consider the petitioner's request for a survey after issuing notice to both the legal heirs of the deceased pattadar. 2/4

Notice should also be issued to owners of relevant adjacent lands. Objections, if any, from the above persons shall be taken into consideration before a decision is taken. The entire process shall be concluded within three (3) months from the date of receipt of a copy of this order. No costs.
