Respondents ( R6 impleaded as respondents vide order of this Court in M.P.No.1/2015 dated 19.03.2015) PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to constitute a selection committee for the post of Principal, Sri Parasakthi College of Women, Courtallam, in accordance with The UGC Regulations and Private Colleges Regulation Act and conduct the selection procedure in accordance with law.

O R D E R

The petitioner has filed the above Writ petition for the issuance of a Writ of Mandamus, directing the 1st respondent to constitute a selection committee for the post of Principal, Sri Parasakthi College of Women, Courtallam, in accordance with the UGC Regulations and Private Colleges Regulation Act and conduct the selection procedure in accordance with law.

2. When the matter is taken up for hearing, Mr.V.R.Shanmuganathan, learned Special Government Pleader, fairly submitted that there was no meeting held by the College Committee and a resolution was passed only by means of circulation and one of the person has not signed the minutes of the meeting, who has been impleaded as the 6th respondent in this case. It is also not in dispute that the University Committee members were not intimated about the issue. The learned Special Government Pleader further submitted that the matter may be placed before the first respondent for constituting a committee and for taking a fresh decision without being influenced by the earlier decision taken by the circulation.

3. In view of the submission made by the learned Special Government Pleader, the matter shall be placed before the first respondent for constituting a committee and such committee shall take a decision on merits and in accordance with law within a period of one month from the date of receipt of a copy of this order. With the above direction, the writ Petition is disposed of. Consequently connected Miscellaneous Petition is closed. No costs.
