ORDER

The present writ petition has been filed seeking a mandamus as against the 1st respondent to consider the request of the petitioner dated 28.10.2025 for re-issuing the passport.

2. According to the learned counsel appearing for the writ petitioner her mother is a Sri Lankan citizen, however, his father is an Indian Citizen and she was born in India in Salem on 11.09.2006.

According to the learned counsel appearing for the petitioner, a criminal case has been registered as against her parents in Cr.No.213 of 2023, on the file of the Inspector of Police, Thammampatti Police Station, Salem, on the ground that they have illegally obtained a passport. However, she would submit that she is born in India and therefore, she is an Indian Citizen by birth. Therefore, criminal case as against her parents cannot be used against her.

4. The learned counsel appearing for the petitioner would further submit that she has got an admission to a Medical College abroad and therefore, she prays to issue passport expeditiously.

5. She also relied upon the decision of this Court reported in W.P.(MD).No.27893 of 2022 dated 30.01.2023, wherein under similar circumstances, this Court has directed the authorities to issue passport.

6. In view of the above said facts, the respondent herein is directed to consider the representation of the petitioner dated 28.10.2025 and re-issue passport within a period of four weeks from the date of receipt of a copy of this order.

7. The writ petition stands disposed of with the above observations. No costs.
