PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the third respondent to execute a Deed of Rectification based on the proceedings issued by the third respondent in No.T/P 23/HBA/KG dated 02.07.2025 before the second respondent and consequently direct the second respondent to make necessary corrections in the encumbrance certificate based on the rectification deed. This Writ Petition has been filed seeking to direct the third respondent to execute a Deed of Rectification based on the proceedings issued by the third respondent in No.T/P 23/HBA/KG dated 02.07.2025 before the second respondent and consequently direct the second respondent to make necessary corrections in the encumbrance certificate based on the rectification deed. 2/6
2.The learned Counsel for the petitioner would submit that while filing re-conveyance deed on the part of the third respondent in page No.25 in the Schedule of property, it has been mentioned as R.S.No.186/43 instead of R.S.No.186/4B and wrongly typed as "South of East West 20 Feet Road instead of North of East West 20 Feet Road". In this regard, the petitioner had already made a representation to the third respondent and the third respondent has issued the proceedings dated 02.07.2025, clarifying that the survey number has to be read as R.S.No.186/4B, however issued no clarification regarding the extent. Hence, the present Writ Petition. 3.Learned Counsel appearing for the third and fourth respondents would fairly submit that error occurred as stated by the petitioner. In this regard, proceedings have been issued on 02.07.2025.
However, he seeks time to file the rectification deed. 4.
