Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the third to fifth Respondents, to pass Award in the Land Acquisition Proceedings initiated in the Notification Na.Ka. No.C.2/17641/2008 dated 11.01.2023 and disburse the Compensation for the acquisition of petitioner's Punja land of 0.30.25 ha. (0.75 cents) out of 0.60.50 ha. in Survey No.25/4, Punja land of 0.42.50 ha. (1 ac. 05 cent) out of 0.85.0 ha. in Survey No. 25/6, Punja land of 0.84.17 ha. (i.e. 2 ac. 08 cents) out of 1.68.00 ha. in Survey No.33/5, 0.03.75 ha (0.09 cents) out of 0.07.50 ha. Wet land in Survey No.33/3 and 0.07.68 ha (i.e.19 cents) out of 0.15.50 ha. wet land in survey No.33/4 and 1⁄2 share in the Well and 5 HP Motor Pumpset in survey No.

33/5 situated in Renganathapuram North Village, Krishnarayapuram Taluk, Karur District and compensation for loss trees and loss of recurring income from the said land and trees and other crops from the year 2014 along with additional value, solatium and interest etc from the year 2014 in accordance with the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The petitioner owned the lands as per the details set out in 2/6

paragraph No.2 of the affidavit. Acquisition proceedings were initiated in the year 2018. The notification was published on 11.01.2023 under Section 11(1) of the Act of 2013. The petitioner relies upon multiple communications with regard to the issuance of an Award and payment of compensation. In spite of lapse of considerable period of time, it is stated that the award has not been issued and compensation has not been paid.

2. Learned Government Advocate accepts notice on behalf of all the respondents. He submits that the matter is pending before the Principal Secretary, Finance Department and that about six months is required to complete the process.

3. The position that emerges on examining the affidavit and documents is that the petitioner is not in a position to use his land in view of the acquisition proceedings. He has also not received any compensation till date. In these circumstances, it is just and necessary that action be taken on an expeditious basis to issue an award and pay compensation.

4. Accordingly, the respondents 3 to 5 are directed to issue the 3/6

award and disburse the compensation to the petitioner for the acquisition within four (4) months from the date of receipt of a copy of this order.
