ORDER

Heard both sides.

2.The petition mentioned property belonged to one Rajamani. She executed settlement deed dated 23.10.2024 in favour of her grandson Kiruthick born through her son Anand. Subsequently, she wanted to cancel the same. It was made clear to her that such cancellation was not possible. It is stated that the family is in need of funds and therefore they have to sell the property. It is well settled that a minor's property cannot be sold without the permission of the Court. That is why the respondent rightly declined to register the sale deed dated 06.11.2025 executed by the petitioner in favour of one Mahamoorthi.

3.I do not propose to set aside the refusal check slip. Instead, I grant relief to the petitioner in the following terms: 2/4

a) Sale deed dated 06.11.2025 states that a sum of Rs.7,72,188/- was received towards sale consideration. The entire amount has to be deposited in any nationalised Bank and invested in an interest bearing account in the name of the minor Kiruthick. The amount so deposited cannot be withdrawn till the minor attains the age of 21 years. The father of the minor child can only withdraw the accrued interest once in three months.

b)The Fixed Deposit receipt with the aforesaid restrictions will have to be shown for perusal before the registering officer. Upon the registering officer being satisfied that the directions of this Court has been complied with, the sale deed dated 06.11.2025 executed in favour of Mahamoorthi can be registered on being re-presented. 4.This Writ Petition is disposed of in the above terms.
