O R D E R

This contempt petition has been filed to punish the respondents for their disobedience of the order of this Court made in WP(MD)No.2363 of 2024, dated 10/12/2024, thereby the petitioner was given liberty to participate in the auction which is to be conducted by the 3rd respondent. 2.The learned counsel for the petitioner submits that initially, writ petition was filed for direction directing the respondents to allot the shops situated within the premises of the Mahatma Gandhi Memorial Government Hospital, Tiruchirappalli, in the light of the order passed in W.A(MD)No.753 of 2019, dated 30/07/2019.

3.On instructions from the third respondent, Mr.T.Amjath Khan, learned Government Advocate submits that in view of the Order passed in G.O.(Ms)No.194, Health and Family Welfare (H2) Department, dated 21/06/2022, shops cannot be allotted directly and it can be allotted by conducting public auction for allotment of the place for shops in the third respondent/hospital's premises.

4.The petitioner was given liberty by this Court to participate in the auction to be conducted by the third respondent. Now the third respondent did not conduct any auction so far. Therefore, by way of this contempt petition, this Court cannot compel the third respondent to conduct auction for allotment of shops in the third respondent hospital premises. Whenever necessary arises, third respondent will conduct auction to allot the shops to the general public and therefore, no contempt will lie.
