Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent 1 to 4 to consider the petitioner's representation dated 18.02.2013 and remove the encroachments made by the 5th respondent, within the stipulated time as fixed by this Court.

************ [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner submitted a representation, dated 18.02.2013 to the fourth respondent requesting him to remove the encroachment made by the fifth respondent in plot No.48, which was latter classified as 48A.

2.It is the case of the petitioner that the road was handed over to the local body and as such the fifth respondent, who purchased the plot latter, has no authority to make encroachment upon the property. Since follow up action was not taken by the fourth respondent, the petitioner has come up with this writ petition.

3.We direct the fourth respondent to consider and dispose of the representation submitted by the petitioner dated 18.02.2013 on merits and as per law with notice to the fifth respondent. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order. The petitioner is directed to submit a copy of the representation dated 18.02.2013 along with a copy of this order, so as to enable the fourth respondent to dispose of the matter, as expeditiously as possible. 4.The writ petition is disposed of with the above direction. No costs.
